In this License, "Florida Tapes," "we," "us," and "our" mean Big Develop Tech & Media, LLC d/b/a Florida Tapes, and "you" / "Buyer" means the person purchasing music on the Platform. This License is part of and incorporated into the Florida Tapes Terms of Service and works together with the Marketplace & Sales Terms and the Refund Policy. By completing a purchase, you accept this License.
The short version: when you buy a track or release on Florida Tapes, you're buying a personal license to listen — stream it in your Library and download it for yourself. You're getting music most people can't hear: while it's listed for sale, it's off free rotation and buyer-only. You are not buying the copyright, and you can't resell it, repost it, or use it commercially. The artist still owns their music, always.
1. WHAT A PURCHASE IS
1.1. A license, not ownership. Your purchase grants you a personal, non-exclusive, non-transferable, non-sublicensable license to the purchased track — or, for a release (album, EP, mixtape, or project), to every track included in that release at the time of purchase. All copyright — in both the master recording and the underlying composition — remains with the artist (or their licensors). Nothing transfers to you, and nothing transfers to us.
1.2. Who grants it. The license is granted by the selling artist, through Florida Tapes acting as the artist's non-exclusive agent for the grant and for delivery. Florida Tapes (Big Develop Tech & Media, LLC) is the merchant of record for the payment — see the Marketplace & Sales Terms.
1.3. Exclusive while listed. While a track or release is listed for sale it is removed from free public rotation on the Platform — only its buyers and the owning artist can play it. If the artist later takes it off sale, it returns to free rotation for everyone; your license and your download are yours either way.
2. DELIVERY — WHAT YOU RECEIVE
2.1. Library streaming. The purchased music appears in your Library on the Platform immediately after payment confirms, and you can stream it there on any device where you're signed in.
2.2. Official download. You may download the purchased audio file(s) from the Platform for your personal use, and keep local copies on devices you own for as long as you like — including after any later delisting.
2.3. That's the whole product. Delivery is complete when the purchase is available in your Library and available for download. No physical goods, stems, artwork files, or other rights are included unless the listing expressly says so.
3. WHAT YOU MAY DO
Strictly for personal, private, non-commercial enjoyment, you may:
- (a) stream the purchased music through your Library on the Platform;
- (b) download it and play it on devices you personally own or control;
- (c) keep personal backup copies of your downloaded files.
4. WHAT YOU MAY NOT DO
Without a separate written license from the artist (which Florida Tapes does not grant and is not part of this purchase), you may not:
- (a) redistribute or share the audio — no uploading to streaming services, video platforms, file lockers, torrents, group chats, or anywhere else;
- (b) resell, rent, lend, gift, or transfer the files or your license to anyone;
- (c) publicly perform or broadcast the music — no venues, radio, podcasts, livestreams, DJ sets, or in-store play;
- (d) synchronize it with visual media — no videos, films, games, ads, or social content, monetized or not;
- (e) sample, remix, mash up, or create derivative works from it;
- (f) use it for any commercial purpose, including advertising, promotion, or products;
- (g) use it to train, fine-tune, or seed any AI or machine-learning system, or to generate imitations of the artist's voice or style;
- (h) circumvent, or help others circumvent, the Platform's access or purchase controls.
Violating this Section is a material breach of this License and the Terms of Service, may terminate your license, and may expose you to direct claims from the artist, whose copyright you would be infringing.
5. TERM & REVOCATION
5.1. Yours for personal use, indefinitely. Your license continues indefinitely for the personal uses in Section 3, and survives the artist delisting the music or changing its price.
5.2. Revocation for breach. We (or the artist) may revoke your license if you materially breach Section 4 or the Terms. Revocation for your breach entitles you to no refund.
5.3. Infringement takedown. If purchased music is removed because the seller had no right to sell it, your streaming access may end — and you will be refunded in full under the Refund Policy. To the extent you received files the seller had no right to sell, your license to them terminates on refund.
5.4. Streaming needs the Platform. Library streaming requires an account in good standing and the Platform's continued operation; your downloaded copies remain playable regardless. Download your purchases — that's what the download is for.
6. REFUNDS
Purchases of digital music are generally final once delivered. The narrow exceptions — duplicate charges, non-delivery, and infringement takedowns — and how to request them are set out in the Refund Policy.
7. GENERAL
7.1. This License is governed by the law of the State of Florida, and disputes are resolved under Section 13 of the Terms of Service (informal resolution, then binding individual arbitration seated in Orange County, Florida, with its class-action waiver and opt-out).
7.2. We may update this License for future purchases; the version in effect when you buy governs that purchase.
