In these Merch & Physical Goods Terms (the "Merch Terms"), "Florida Tapes," "we," "us," and "our" mean Big Develop Tech & Media, LLC d/b/a Florida Tapes ("BDTM"). These Merch Terms are part of and incorporated into the Florida Tapes Terms of Service and the Marketplace & Sales Terms, and they apply to everyone who lists, sells, or buys physical merchandise ("merch") on Florida Tapes. Shipping, delivery estimates, and returns for physical goods are governed by the Shipping & Returns Policy.
The short version: Any Florida Tapes artist can sell physical merch — apparel, prints, accessories, and other goods. The artist owns the design, sets the retail price, and either (a) uploads and fulfills items themselves or (b) connects Printify, so that when something sells we automatically place the print-on-demand order to the artist's own Printify account and Printify prints and ships it to the buyer. Florida Tapes runs the store and is the merchant of record: we process the payment, collect the buyer's shipping address, keep a 10% platform fee, and absorb card-processing costs out of our share. The artist keeps 90%, out of which the artist pays their own Printify base and shipping cost. Merch is open to every artist — there is no eligibility gate.
1. WHAT MERCH IS — AND WHAT WE ARE
1.1. A marketplace for physical goods. Merch sales are physical-product transactions between the selling artist and the buyer. Florida Tapes facilitates each sale: we host the listing, process the payment, collect the buyer's shipping address, trigger fulfillment, and split the proceeds. Unlike music, merch is open to every Florida Tapes artist — there is no listen threshold or eligibility gate to sell physical goods.
1.2. We are not a manufacturer or a label. We do not design, print, warehouse, own, or ship the goods. Printing and shipping are performed either by Printify (through the artist's connected account) or by the artist directly. We are not the author, licensor, or rights holder of any design.
1.3. Merchant of record. For each merch sale, BDTM is the merchant of record: the charge is processed by us via Stripe, appears on the buyer's statement with our FLORIDATAPES descriptor, and we are responsible for the payment transaction, receipts, and any refund handled under the Shipping & Returns Policy. Merchant-of-record status covers the transaction — it does not make us the maker, seller of record for product-liability purposes, or rights owner of the goods, which remain the artist's responsibility under Sections 2 and 6.
2. WHO CAN LIST, AND WHAT THEY WARRANT
2.1. Open to all artists. Any artist with a Florida Tapes account in good standing may create merch listings. Listing merch does not affect the exclusivity, rotation, or eligibility of that artist's music.
2.2. You own your designs. By listing merch, the artist represents and warrants that they own or control 100% of the rights in every design, artwork, name, logo, photograph, and other element on the product, and that the product and its sale do not infringe any copyright, trademark, right of publicity, or other right of any third party.
2.3. No infringing or prohibited goods. Artists may not list counterfeit goods, unlicensed third-party marks or likenesses, unsafe or recalled products, or anything prohibited by the Community Guidelines, the Terms of Service, Printify's own policies, or applicable law.
2.4. Indemnity. The artist agrees to defend, indemnify, and hold harmless Florida Tapes and BDTM, and our officers, employees, and vendors, from any claim, loss, or expense (including reasonable legal fees) arising out of the artist's designs or products, the sale or fulfillment of their merch, a breach of these warranties, or a dispute with a buyer or with Printify. This indemnity survives removal of a listing and closure of an account.
3. LISTING METHODS: MANUAL & PRINTIFY
3.1. Manual items. An artist may upload a product directly: name, description, retail price, one or more images, and where relevant variants (such as size or color) and stock. For manual items the artist is solely responsible for fulfillment — printing or sourcing, packing, and shipping to the buyer — within the delivery expectations in the Shipping & Returns Policy.
3.2. Printify items (auto-fulfillment). An artist may connect Printify and import products. When a connected artist's Printify item sells, Florida Tapes automatically places the corresponding print-on-demand order to that artist's own Printify account, using the variant purchased and the shipping address the buyer entered at checkout. Printify then prints and ships the item directly to the buyer under Printify's own production and shipping terms.
3.3. You authorize the automatic order. By connecting Printify and keeping items listed, the artist authorizes Florida Tapes to place fulfillment orders on the artist's behalf through the artist's connected Printify account for each sale, and authorizes the charges Printify assesses the artist for those orders (base cost plus shipping). This authorization continues until the artist disconnects Printify or unlists the item (Section 5).
3.4. Accurate listings. Whichever method is used, the artist is responsible for the accuracy of product details, images, variants, availability, and price. If an item cannot be fulfilled (out of stock, discontinued at Printify, or a rejected order), the buyer is refunded under the Shipping & Returns Policy.
4. PRICING, FEES, PAYOUTS & TAXES
4.1. Artist-set retail price. The artist sets the retail price of each item within the platform band ($1.99 to $500.00). All prices are in U.S. dollars (USD). The price shown at checkout is the price the buyer pays.
4.2. Platform fee and card costs. On each merch sale Florida Tapes retains a 10% platform fee of the gross retail price and absorbs the card-processing costs out of that fee. The artist receives 90% of the gross retail price, paid via Stripe Connect.
4.3. Printify base and shipping cost is the artist's cost. For Printify items, the artist's Printify account is charged Printify's base production cost plus shipping for each order we place. That cost comes out of the artist's 90% — Florida Tapes does not pay, reimburse, or mark up the artist's Printify costs. Artists are responsible for pricing their items high enough to cover their own base and shipping cost after the 10% fee. For manual items, all sourcing, printing, and shipping costs are likewise the artist's.
4.4. Taxes. Where we are required to collect sales or similar transaction taxes on a purchase, they are shown at checkout and remitted by us. All other taxes are the artist's responsibility, including the artist's own income, self-employment, and business taxes on merch earnings.
5. CONNECTING & DISCONNECTING PRINTIFY (DATA NOTE)
5.1. What connecting does. To connect Printify, the artist provides a Printify Personal Access Token. That token lets Florida Tapes, on the artist's behalf, read the artist's Printify shops and products (to import listings) and place fulfillment orders when items sell.
5.2. We never see your Printify password. A Personal Access Token is not a password. Connecting Printify does not give Florida Tapes the artist's Printify login or password, and we never ask for it. The token grants only API access to the artist's Printify account.
5.3. How the token is stored. The token is stored server-side only, in a restricted vault that our normal application access cannot read; it is used solely to import products and place orders for that artist. We never display the raw token back to the artist or anyone else and never expose it to the browser — connection screens show only whether Printify is connected and the connected shop name.
5.4. How to disconnect. The artist may disconnect Printify at any time from their seller settings, which deletes the stored token and stops any further automatic orders. The artist may also revoke the token directly in Printify. After disconnecting, Printify items can no longer be auto-fulfilled and should be unlisted. Disconnecting does not cancel orders already placed or reverse completed sales.
6. FULFILLMENT, RISK & PRODUCT RESPONSIBILITY
6.1. The artist stands behind the product. As between the artist and Florida Tapes, the artist is responsible for the merch — its quality, safety, legality, description accuracy, and delivery (directly or through Printify). Florida Tapes provides the storefront and payment rails; we do not manufacture or inspect goods.
6.2. Printify's role. For Printify items, production and shipping are performed by Printify and its print providers under Printify's own terms. Timelines, product quality, and misprint handling follow Printify's policies, as reflected in the Shipping & Returns Policy.
6.3. Shipping address is the buyer's data. The buyer's shipping address is collected at checkout solely to fulfill the order. It is treated as personal information under the Privacy Policy: it is snapshotted on the order, shared only as needed to fulfill the order (with Printify or the shipping artist), and not used for any other purpose.
7. MODERATION & DELISTING
7.1. We may delist or moderate. Florida Tapes may remove, hide, or delist any merch item or block any seller at our discretion — for infringement, unsafe or prohibited goods, inaccurate listings, buyer-safety concerns, fulfillment failures, chargeback abuse, legal compliance, or violation of these Merch Terms or the Terms of Service.
7.2. Enforcement against sellers. Repeated or serious violations — especially selling goods the artist has no right to sell, or failing to fulfill — may result in loss of merch selling privileges, payout holds for affected orders, suspension, or termination under the Terms of Service.
7.3. Effect on completed orders. Delisting an item does not by itself cancel orders already paid for; open orders are fulfilled or refunded under the Shipping & Returns Policy.
8. BUYER TERMS FOR MERCH
8.1. Accurate shipping details. Buyers must provide a complete, accurate shipping address. Failed or returned deliveries caused by a wrong address entered by the buyer may not be refundable (see the Shipping & Returns Policy).
8.2. Physical goods, not digital. Merch is a physical product shipped to the buyer; it is not a music license and confers no rights in any recording. Delivery times are estimates and depend on production and carrier timelines.
8.3. Returns and problems. Returns, replacements for defective or misprinted items, and how to report an order problem are covered by the Shipping & Returns Policy. Please contact info@bigdevelop.com before disputing a charge with your bank.
9. DISCLAIMERS & LIABILITY
9.1. Marketplace "AS IS." The merch marketplace is provided "AS IS" and "AS AVAILABLE." We do not warrant any product's quality, safety, or fitness — those are the artist's and, for Printify items, Printify's responsibility. The disclaimers and limitation of liability in Sections 10 and 11 of the Terms of Service apply in full to merch.
9.2. No guarantee of availability. We do not guarantee that any item, variant, price, or seller remains available for any period.
10. CHANGES; GOVERNING LAW; CONTACT
10.1. We may update these Merch Terms; material changes will be posted with a new "Last updated" date. The version in effect at the time of a purchase governs that purchase.
10.2. These Merch Terms are governed by the law of the State of Florida; disputes are resolved under Section 13 of the Terms of Service (informal resolution, then binding individual arbitration seated in Orange County, Florida, with its class-action waiver and opt-out).
